Credit cards are just another aspect of our world obsessed with “convenience,” allowing us to have instant money on credit. Ohio credit card case law suggests that credit card companies and purchasers of credit card debt have persuaded some courts to allow them a degree of “convenience” in preparing and prosecuting their claims by procedural and evidentiary shortcuts that other plaintiffs might not be allowed. This course is intended to demystify credit card law. At its heart, a credit card collection case is little different from an ordinary contract claim or an action on an account. Though federal law controls the framework of these transactions, common law and equitable principles still apply in court as do the rules of procedure and evidence. We will discuss the law and rules that would apply in similar cases and the apparent movement in the courts to accord these plaintiffs liberties which, if not curtailed, perhaps should be extended across all civil litigation. This course may be useful to anyone who must analyze, prosecute or defend collection cases, whether or not involving credit cards.
