Achieving a Fair Divorce When
A Spouse or Child is Disabled

Special Needs Trusts can be key to achieving a fair divorce when a spouse or child is disabled.  When drawing up a divorce settlement it is important for the attorney to be aware of the importance of safeguarding eligibility for government programs by creating Special Needs Trusts to supplement disability assistance, not replace it.  This program will describe the basic government programs like Medicaid and Supplemental Security Income.  We will define Special Needs Trusts, set out the requirements for a creating an effect trust, and discuss how they can be beneficial in divorce situations.
